To the maximum extent permitted by law, Level2 and its affiliates shall not be liable for any loss or damage arising directly or indirectly from:

• any delay, failure, interruption, or corruption of any data transmission, system, or network;
• any bug, defect, or error in the Level2 platform or related software;
• any failure to execute, trigger, or complete a trade, strategy, or automated instruction; or
• any loss of profits, trading losses, loss of opportunity, or similar consequential damages, whether foreseeable or not.

The Level2 platform and all related services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.

In all cases, Level2’s total aggregate liability to you shall not exceed the total subscription fees paid by you to Level2 in the twelve (12) months immediately preceding the event giving rise to the claim.

The Level2 platform and all associated automated functions, tools, and features are provided on an “as is” and “as available” basis. While Level2 takes reasonable steps to maintain the reliability and performance of its systems, we do not warrant or guarantee that the service will operate without interruption, delay, error, or defect.

Level2 does not guarantee the execution, triggering, or completion of any analysis, signal, or automated process. You acknowledge that system errors, connectivity issues, latency, or other technical failures may prevent trades or signals from being generated or executed as expected.

To the fullest extent permitted by law, Level2, its members, shareholders, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, or consequential loss, damage, or expense arising from any such system issue, technical failure, or delay in performance. You accept full responsibility for monitoring your own trading activity and managing your associated risks.
